Terms of Service (draft)

This is a working draft. It must be reviewed and adapted by a qualified lawyer before launch. Bracketed items are placeholders for the operator to fill in.

1. The service#

[Operator legal name] ("we") provides an email API for software agents (the "Service"). By creating an account you agree to these terms on behalf of yourself or the organisation you represent.

2. Accounts#

You must provide accurate information and keep your credentials and API keys secret. You are responsible for activity under your account. Sending requires a verified email address.

3. Acceptable use#

You must follow the Acceptable Use Policy. We may suspend or terminate accounts that send unsolicited bulk mail, cause complaints, or put our sending reputation at risk.

4. Plans, billing and taxes#

Paid plans are billed in advance, monthly or yearly, through Stripe or Razorpay. There is no free trial. Downgrades take effect at the end of the paid period. If a payment fails the account enters a grace period of seven days and then falls back to the Free plan limits. Prices shown are in [currency] and may change with notice. [Tax treatment, including GST or VAT invoicing, to be determined.]

5. Your content and data#

You own the messages you send and receive through the Service. You grant us the limited right to store, process and transmit them to provide the Service. [Retention and deletion periods to be specified.]

6. Availability and support#

The Service is provided on a reasonable-efforts basis. [Service levels, if any, to be specified.]

7. Disclaimers and liability#

[Warranty disclaimer and limitation of liability to be drafted by counsel.]

8. Termination#

You may close your account at any time. We may suspend or terminate the Service for breach of these terms. [Data export and deletion on termination to be specified.]

9. Changes, governing law and contact#

[Change notification process, governing law, jurisdiction and contact address to be specified.]
